Governing the use of the Photo Selling feature on Kamero

These Terms & Conditions ("Terms") govern the use of the Photo Selling feature on Kamero ("Platform," "we," "our," or "us"). By enabling photo selling or purchasing photos, you agree to the following.

1. Feature Overview

  • Photographers, event owners, or event admins ("Sellers") can mark any event as a for-sale event, allowing end-users ("Buyers") to purchase individual photos, bulk "my photos" (face-matched), or all event photos.
  • The Seller sets per-photo pricing in both INR and USD for each event. All photos within an event share the same per-photo price.
  • Sellers may optionally configure volume discounts (e.g., buy 10+ photos and get 15% off) and flat-rate bulk pricing for "all my photos" or "all event photos" packages.
  • Sellers can update pricing and discount tiers at any time via their dashboard. Price changes apply to future purchases only and do not affect existing orders.
  • Buyers browsing the gallery see watermarked preview images. After purchase, buyers receive access to the original, unwatermarked, full-resolution photos.

2. Copyright & Ownership

  • Sellers may only upload and sell images for which they hold full copyright and ownership rights.
  • Sellers confirm they have all necessary permissions, licenses, model releases, and property releases (where applicable) for selling such images.
  • Sellers agree to indemnify Kamero against any claims, disputes, or liabilities arising from copyright infringement, misuse of content, or lack of appropriate releases.
  • Purchasing a photo grants the Buyer the right to use, publish, and share the photo for any personal or commercial purpose. However, it does not transfer copyright or ownership to the Buyer.

3. Watermarks & Image Protection

  • To protect images, Kamero automatically applies a full-size watermark on all gallery preview images before purchase.
  • Once a photo is purchased, the Buyer receives access to the original uploaded resolution without the watermark.
  • Sellers may customise the watermark style and text (including their brand name or logo) via the sale watermark configuration in their dashboard.

4. Cart, Pricing & Payments

  • Buyers may add individual photos to their cart and check out, or use the "Buy Now" option for a single photo (bypassing the cart).
  • Bulk purchase options — "Buy All My Photos" (face-matched) and "Buy All Event Photos" — are available when enabled by the Seller, each at a flat price set by the Seller.
  • Volume discounts, if configured by the Seller, are automatically applied at checkout based on the number of photos in the cart.
  • Payment gateways:
    • INR transactions: PhonePe (UPI, cards, net banking).
    • USD transactions: PayPal.
  • The currency is automatically determined based on the Buyer's location (India → INR, international → USD).
  • For INR transactions, applicable GST (Goods and Services Tax at 18%) is added to the order total. The GST breakdown (CGST/SGST or IGST) is determined by the Buyer's state and is shown on the invoice.

5. Commission & Charges

  • Kamero charges a default commission of 20% per transaction on the cart amount (before GST). This commission includes payment gateway processing charges.
  • The commission rate may be customised per Seller based on their business agreement with Kamero.
  • The remaining amount (after commission deduction) is credited to the Seller's wallet as the net seller payout.
  • Commission is non-refundable.
  • A detailed financial breakdown — including platform fee, GST on platform fee, and net seller amount — is available for every order in the Seller dashboard.

6. Seller Wallet & Payouts

  • After a successful purchase, the net seller amount is automatically credited to the Seller's wallet. Wallets maintain separate INR and USD balances.
  • Sellers can view their wallet balance, transaction ledger, and order history from the Seller Dashboard.
  • Payouts from the wallet to the Seller's bank account are processed upon the Seller's request. To be eligible for payouts, Sellers must complete all required business details and upload the necessary documents at Business Settings. Payouts will only be processed after Kamero has verified the submitted details and documents.
  • Once processed, payouts cannot be reversed. Sellers are responsible for ensuring their bank details are accurate.

7. Invoices & Receipts

  • Kamero issues a Platform Invoice only for the platform commission amount charged by Kamero (with GST breakdown for INR orders).
  • For the Seller's portion, Kamero issues a Payment Receipt showing the net amount credited to the Seller's wallet. It is the Seller's responsibility to produce and provide a tax invoice to the Buyer wherever required.
  • Both the Platform Invoice and Payment Receipt are available as downloadable PDFs from the order detail page in the Seller Dashboard.
  • Buyers can view their order history and download details from the "My Orders" section.

8. Buyer Access & Downloads

  • After a successful purchase, Buyers can download their purchased photos from the "My Orders" section on the Kamero website.
  • Each download generates a time-limited, secure download link to the original full-resolution photo.
  • Download activity is tracked for audit purposes (download count, timestamps).

Important — Photo Availability

If the Seller (event owner) deletes photos from the event or deletes the event itself, those photos will no longer be available for download — even for Buyers who have already purchased them. The watermarked gallery previews will also be removed.

Kamero does not retain copies of deleted photos. We strongly recommend that Buyers download their purchased photos promptly after purchase.

Kamero is not responsible for restoring access to photos that have been deleted by the Seller.

9. Refunds & Disputes

  • All photo sales are final. Once a Buyer completes payment and the order is marked as completed, no refund or cancellation is possible.
  • If a payment fails or is not completed, no order is created and no amount is charged. If any amount was deducted by the payment gateway during a failed transaction, it will be automatically refunded by the payment provider within 5–7 business days.
  • In case of disputes between Buyers and Sellers, Kamero may review the transaction but holds no liability for buyer–seller disagreements regarding photo quality, content, or usage.

10. Content Moderation & Removal

  • Kamero reserves the right to remove or restrict any content that violates our Terms of Service, Privacy Policy, or applicable laws.
  • Sellers may remove their own events and photos at any time. However, as noted in Section 8, this will remove access for all users including Buyers who have purchased those photos.

11. GST & Tax Compliance (India)

  • For INR transactions, GST at 18% is applicable on the platform commission fee. The GST is broken down into CGST + SGST (for intra-state) or IGST (for inter-state) based on the Buyer's location.
  • If the Seller is GST-registered, an additional 18% seller GST may apply on the seller's portion. This is reflected in the order total charged to the Buyer.
  • In such cases, Kamero collects the applicable GST on the Seller's portion from the Buyer and passes it on to the Seller. It is the Seller's sole responsibility to file and remit the GST collected to the appropriate tax authorities.
  • Sellers who are GST-registered should provide their GST number and business details in their dashboard for accurate invoicing.
  • For USD (international) transactions, no GST is applied.

12. Liability & Responsibility

  • Sellers are solely responsible for the ownership, rights, and quality of the photos they list for sale.
  • Kamero is not liable for copyright infringements, misuse of images, or disputes arising from photo sales.
  • Kamero does not guarantee the perpetual availability of purchased photos. Availability depends on the Seller maintaining the event and photos on the platform.
  • Kamero's liability is limited to the amount collected by Kamero as platform commission or event pack fees.

13. Governing Law

  • For Indian users, these Terms are governed by and construed under the laws of India.
  • Disputes, if any, shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
